Terms of Use
Purpose of the Site and acceptance of the Terms
This Rocha Avocat website (the "Site") presents the firm's legal services (primarily immigration law) and provides general information for illustrative purposes. The Site allows users to contact the firm, book appointments online, access a secure client portal, and use a virtual assistant (chatbot) for general enquiries.
Accessing or browsing the Site constitutes acceptance of these Terms of Use. If you do not agree, do not use the Site.
Rules for using the Site
Each User agrees to use the Site in good faith, in compliance with applicable laws and these Terms. In particular, the User must not:
- Misuse the Site for unlawful purposes (e.g., distributing illegal content, hate speech or defamation, intrusion or hacking) or use it in a way that could damage, disable, or overload the Firm's infrastructure;
- Impersonate another person or provide inaccurate personal information when using forms or registering for the secure client area; the User is responsible for keeping login credentials confidential and for all activity under their account;
- Use the chatbot or any other communication tool on the Site to transmit sensitive information, spam, or inappropriate content.
If these rules are breached, the Firm may suspend or deny the offending User's access to the Site, without prejudice to any further legal action.
Intellectual property
The Site's content — including, without limitation, text, logos, graphics, images, videos, databases, and the site's structure — is the exclusive intellectual property of Rocha Avocat or its partners. This content is protected by copyright, trademark law, and other intellectual property provisions.
Users are not authorised to reproduce, display, modify, translate, or distribute any part of the Site without the Firm's prior written consent. Only strictly private, personal, and non-commercial use is permitted, provided the content is not altered and copyright notices are retained.
Disclaimers and liability
Information on the Site is provided on a general, indicative basis. The Firm strives to keep the Site and its information up to date and accurate, but does not guarantee that content is comprehensive, complete, or error-free. It does not constitute personalised legal advice. Users should consult a lawyer for advice tailored to their situation.
The Site is generally available 24/7, but the Firm does not guarantee uninterrupted or error-free operation. Maintenance, updates, or technical issues may make the Site temporarily unavailable. The Firm accepts no liability for any damage resulting from unavailability or technical malfunctions (including data loss, intrusion, viruses, or other IT issues).
The Site may contain hyperlinks to third-party websites or external sources provided solely for User convenience. The Firm has no control over those resources and cannot guarantee their accuracy, timeliness, or availability.
Chatbot and automated answers
The Site provides a virtual assistant (AI-powered chatbot) to answer users' general questions. The Firm notes that responses are generated automatically and may be approximate or incomplete. Despite quality filters and controls, these responses do not constitute professional legal advice.
Users are strongly advised not to disclose sensitive information via the chatbot and to contact the Firm directly for specific or confidential matters. Exchanges with the AI are not covered by legal professional privilege and do not create a lawyer-client relationship.
Governing law and jurisdiction
These Terms of Use are governed by French law. In the event of any dispute relating to use of the Site that cannot be resolved amicably, exclusive jurisdiction lies with the competent French courts.
Any dispute between the Firm and a non-professional User (consumer) will be resolved under French law and, where applicable, brought before the territorially competent courts pursuant to consumer protection rules. By default, disputes concerning the Site will be brought before the courts within the Nice judicial district.
